These terms govern use of the HardRay Productions website and explain how published service information relates to actual bookings and projects.
1. Website Purpose
This website provides general information about HardRay Productions, its drum-production services, DJ services, current pricing, policies, and ways to make an inquiry. Website content is not itself a service agreement.
2. Quotes, Pricing and Availability
Published prices describe standard services and packages. A project or event may require additional work, equipment, travel, preparation, or other accommodations. Any additional charge will be discussed before HardRay Productions accepts the work. A website inquiry does not guarantee availability, lock in a date, or create a contract.
3. Booking and Project Acceptance
Drum projects begin only after HardRay Productions has accepted the project, received the required files and instructions, and received the required payment or deposit. DJ dates are reserved only after the required service agreement and booking deposit have been received.
4. Client Responsibilities
Clients are responsible for providing accurate contact, project, event, venue, schedule, music, file, and deadline information. Clients must have the necessary rights or permission to provide HardRay Productions with songs, recordings, files, images, reference materials, and other content supplied for a project.
5. Drum Production Deliverables
Deliverables depend on the selected service and may include stereo drum mixes, stems, acoustic multitracks, edited tracks, processed tracks, WAV files, MIDI files, and reference mixes. Exact deliverables will be confirmed for the project.
6. Revisions and Scope Changes
Standard drum projects include two revision rounds. Additional revisions are billed as stated on the Drum Production section of the website. Material changes to the song, production direction, arrangement, structure, or scope after work begins may require additional charges, which will be discussed before additional work is performed.
7. Intellectual Property, Credits and Royalties
Payment for a standard HardRay Productions drum service permits the delivered drum performance or production to be used in the song for which it was commissioned. A standard session fee does not automatically create a royalty, songwriting, publishing, or master-ownership obligation to HardRay Productions. Any songwriting, co-production, royalty-bearing, or other ownership arrangement must be separately agreed in writing. Appropriate credit is requested when project credits are published.
8. Website Content
Unless otherwise stated, HardRay Productions branding, original website text, graphics, and original media are owned by or used with permission of HardRay Productions. Website materials may not be copied and presented as another business's materials without permission.
9. Portfolio Music and Third-Party Copyrights
HardRay Productions may display performance, DJ, remix, production, or demonstration clips that contain third-party copyrighted music. HardRay Productions does not claim ownership of third-party musical compositions or sound recordings appearing in those clips. All such rights remain with their respective copyright owners. Portfolio clips are presented to demonstrate HardRay Productions' performance, drumming, DJ, and production work. This notice does not itself grant a license or replace any permission that may be required from a copyright owner.
10. Third-Party Services
Links to social networks, music platforms, file-storage providers, payment providers, venues, or other third parties are provided for convenience. HardRay Productions does not control their websites, availability, security, content, or policies.
11. Service Limitations
HardRay Productions may decline work that is outside its musical specialties, current equipment capabilities, available schedule, service area, technical capabilities, or other reasonable business limitations. DJ system suitability depends on factors including venue, guest count, event type, indoor/outdoor conditions, and production requirements.
12. Controlling Agreement
If these website terms conflict with a signed project or DJ service agreement, the signed agreement controls for that particular booking or project.
13. Changes
HardRay Productions may update website information, offerings, and policies prospectively. Changes do not alter a previously signed agreement unless the parties agree to the change.
